Q: What happens at the initial individual intake session?

 

At the outset it is really important to appreciate that reaching a successful outcome for you and your family starts now.

Choosing who to trust to look after your family in this transition is understandably difficult.

I have looked after more than 6,000 families who have experienced what you are going through and I have learned that a big part of reaching an acceptable solution is devoting a sufficient amount of time to the process from the beginning.

A comprehensive individual intake session sets you up for success in the resolution pathway you choose.

Being thorough from the start takes time and this is why your individual intake session with me will take close to 90 minutes.  A lot of ground needs to be covered in this session to ensure that I understand your particular circumstances and needs and can tailor the process to best suit your family.

This process cannot be rushed.

Along with taking a history of your relationship it is important for us at this stage to talk about:-

  • Your patterns of communication in the past and what has worked and what has not worked for you.
  • The recurring topics that you argue about and why you think this is so.
  • Your most recent interactions; what happened and how successful they were.
  • Why you think you have not been able to reach agreement yet and what you think may be needed to make this different?
  • In matters involving financial settlement; an understanding of the matrimonial pool of assets to be divided including the value of the assets, liabilities and superannuation entitlements. When valuations are not agreed what you each propose to resolve that difference.
  • In matters involving children; an understanding of each child’s particular interests and needs and when there is more than one child an appreciation of the sibling dynamics.

Who, what, why, when and how questions enable me to provide the tailored service that you are ideally looking for even if you do not really know yet what that is.  These types of questions are really useful and include:-

WHO

  • Who else may need to be involved in the dispute resolution process? Other experts and/or family members?
  • Who does not need to be involved in the dispute?
  • Who might be the gatekeepers in this conflict?

 

WHAT

  • What are you seeking from the dispute resolution process?
  • What will you do if you cannot resolve the issues now?
  • What preparation and/or homework is required before we commence?
  • What information is missing? And what is not being said?

 

WHY

  • Why is this matter unresolved?
  • Why are these issues so important to you?

 

WHEN

  • When you are with your ex, what is it like?
  • When you are available to start this process?

 

HOW

  • How have you attempted to resolve the issues before?
  • How would you like to see these issues resolved?
  • How long should each of the sessions go for?
  • How are you presenting at this time?
  • How have you got on managing challenges in the past?

 

Appreciating the complexity of this situation in all its facets is fundamental to this stage.  An individual intake is also a safe environment for you to ask questions and build confidence in the process and in me.

Ensuring that you understand the extent of the confidentiality that is provided by various dispute resolution processes is also a really important part of the intake session.

The intake session is highly nuanced, responsive to your individual circumstances and for all of these reasons ensuring that you are looked after in the process means that you need to allocate the time to this stage that it deserves.

The conflict between you and your ex defines the table at which we are working as dispute resolution practitioners.  I strive to restore and support a level of functional communication between you both and look for a way that you and your family can not only achieve a resolution of the current dispute but can set the foundations for you to employ better strategies into the future.

The services provided to you are adapted to your unique family and personal circumstances.  Through this intake session it is intended that a level of rapport will be developed and you will trust me and engage me to help you.
